Rental Agreement
I agree to assume all responsibility for loss or damage incurred to the instrument rented during the rental period (normal wear excluded), and to return or renew the instrument by the due date. I absolve Ardsley Musical Instrument Service (AMIS) from any claims arising from the use of the rented instrument. I understand that damage protection (DP) is required and covers damage resulting from normal use. DP does not cover loss, theft, broken strings, vandalism, engravings, excessive dents, crushed bells or instruments, holes, broken bows, missing parts and/or attempts at repair by non-AMIS personnel. Attempts at such repair may void coverage and incur repair or replacement fees. Optional Instrument Replacement Protection (IRP) covers replacement of legally substantiated (police/fire/school report required) theft of the assigned rented instrument from home or school (one instrument per rental period). Claim must be made within 10 business days of occurrence. IRP does not cover bows, parts, accessories, acts of negligence, instruments left in vehicles or on transportation, and expires with rental. I understand that there are no refunds on early returns except on new rentals rented in September and returned before October 1st of the same year, and that there are no refunds on renewals unless I qualified for the change or heart refund on or before due date. If my school allows school service and I would like AMIS to pick up the instrument from the school, I agree to follow return instructions provided by AMIS. If I miss the assigned pickup date, I agree to return the instrument to the office of AMIS by the end of the 10 day grace period. I understand that the school is neither responsible for the return of my instrument nor involved in this agreement. Attempts to return an instrument with a serial number other than that assigned, whether through the school or in person, void IRP coverage as do unauthorized, careless or irresponsible returns through school. I agree to either return OR renew the instrument, not BOTH. If I return AND renew my instrument at the end of the year, I agree to pay a $25.00 administrative fee to have the instrument delivered back to the school. I agree to pay a $1.00 per day past due fee in addition to the initial renewal fee and protections commencing 10 days past the due date. If the instrument becomes 60 days past due, I give AMIS full authorization to charge my credit card for the instrument replacement fee plus a $1.00 per day past due fee. If my credit card is declined, I agree to provide a replacement card and or pay in person by check, money order or cash. I agree to pay any collection and/or legal fees incurred. I understand that AMIS may report my past due account/s to credit rating services. I agree to update my credit card information, address, school and all contractual information. I understand that this contract is not transferrable, AMIS is not responsible for personal items left in cases, and that instrument exchanges are a courtesy and will be provided if and when available.
Protection Agreement
Instrument Replacement Program (I.R.P.) Agreement
In the event of loss by THEFT from school or home or loss by fire Ardsley Musical Instrument Service agrees to provide the lessee with a replacement instrument. The balance of the account on the original instrument will remain the responsibility of the lessee as amended to reflect the description of the replacement. PROOF OF LOSS BY THEFT FROM SCHOOL OR HOME MUST BE SUBSTANTIATED BY LESSEE SUPPLYING ARDSLEY MUSIC WITH ORIGINAL SIGNED COPIES OF A POLICE REPORT AND LOSS REPORT FORM (LOSS REPORT FORM WILL BE PROVIDED BY ARDSLEY MUSIC ON REQUEST). PROOF OF LOSS BY FIRE MUST BE SUBSTANTIATED BY LESSEE SUPPLYING ARDSLEY MUSIC WITH ORIGINAL SIGNED COPY OF INSURANCE REPORT. ALL REQUIRED REPORT FORMS MUST BE SUBMITTED TO ARDSLEY MUSIC WITHIN 10 BUSINESS DAYS OF OCCURRENCE. In the event that the lessee desires not to purchase I.R.P., lessee will assume full responsibility for the replacement of the instrument leased. Fraudulent representation of loss by theft or fire is a crime and will be punished to the full extent of the law. INSTRUMENT REPLACEMENT PROTECTION TERMINATES IF THE RENTED INSTRUMENT BECOMES PAST DUE. TO REMAIN EFFECTIVE INSTRUMENT REPLACEMENT PROTECTION MUST BE RENEWED AT THE TIME OF THE INSTRUMENT LEASE RENEWAL.
EXCLUSIONS
NOT COVERED BY INSTRUMENT REPLACEMENT PROTECTION AGREEMENT are accessories (such as but not limited to mouthpieces, reeds, drumsticks, drum heads, mechanism screws, strings, rosin, lubricants) and instruments stolen from parked cars, left on school bus or on other forms of transportation. Lessee understands that the school is not involved in this agreement and instruments lost as a result of irresponsible or careless return through the school and/or negligence are not covered by I.R.P. Any attempt to return an instrument with a serial number other than that of the original instrument rented negates the coverage of the original instrument. Replacement of the original instrument becomes the full responsibility of the lessee. No I.R.P. payments are applicable toward the purchase of the instrument. I.R.P. can be denied to any individual or group at the discretion of the Ardsley Musical Instrument Service Board of Directors.
